The law's provisions, jurisdiction, and societal control reveal shocking characteristics of totalitarian dictatorship, which can be described as 'lawless and inhumane.'
Essentially, this law legalizes Xi Jinping's political slogan of 'forging a strong sense of the Chinese national community.' While the CCP claims it is a law to 'promote national unity,' it actually includes several absurd and dictatorial provisions:
1. Article 63: Overseas criticism results in direct conviction
The most outrageous aspect of this law is its blatant 'long-arm jurisdiction.' The text explicitly states: 'Organizations and individuals outside the People's Republic of China that engage in acts undermining national unity and progress or creating ethnic division against the People's Republic of China shall be held legally accountable according to the law.'
This means that whether you are from Taiwan, Hong Kong, or a politician, businessman, or ordinary netizen from another country, if you criticize the CCP's policies towards ethnic minorities in Xinjiang, Tibet, or Inner Mongolia while outside of China, or question its suppression of religion or language, you have already violated this law in the eyes of the CCP. As soon as you set foot on Chinese territory (including transit through Hong Kong or Macau), you could be arrested under this law at any time. This mirrors the 'Hong Kong National Security Law' and the 'Anti-Espionage Law,' representing a systematic 'weaponization of law.'
On the 21st, Tsukasa Shirakawa, the Deputy Secretary-General of the Tokyo Metropolitan Assembly faction of Japan's Liberal Democratic Party, published a letter in the well-known Japanese business magazine "PRESIDENT," warning that Article 63 of the law, known as the "Overseas Application Clause," effectively serves as a "legal permit" for transnational arrests worldwide. In the future, this could implicate not only overseas Chinese but also foreigners who express support for Taiwan in their own countries, potentially facing prosecution by the Chinese Communist Party (CCP) under charges of secession.
2. Not opposing "independence" equates to "not supporting unification is a crime" (non-unification equals independence)
Historically, the CCP had certain red lines regarding the definition of "Taiwan independence"; however, this new law elevates the concept of the "Chinese national community" to its utmost significance. From the CCP's perspective, "not actively supporting unification and not recognizing its community" is directly equated with secession.
This law blurs the legal red lines, attempting to eliminate the ambiguous space for Taiwanese people to "maintain the status quo." This goes beyond mere anti-independence; it represents a blatant legal strategy to enforce "anti-independence coercion for unification" and political intimidation. It not only restricts individuals' freedom to remain neutral but may also create a chilling effect on cross-border repression, putting those overseas who support Taiwan or criticize the CCP's ethnic policies at risk of entry and exit issues and personal threats.
3. Article 20: Forcing parents to harm the next generation
In terms of internal control, this law intrudes directly into the privacy of families. The provisions state: "Parents or other guardians of minors... must educate and guide minors to love the Chinese Communist Party and love the motherland... and must not instill concepts that are detrimental to national unity and progress in minors."
This law compels parents to actively instill the 'will of the Party' in their children, effectively brainwashing them to become 'cannon fodder and sacrifices for the Party', contributing their youth and lives to the Communist Party's cause.
If parents speak the truth to their children at home, or if ethnic minority parents wish to pass on their community's true history and reject official indoctrination, they can be reported and labeled as 'guardians violating the law'. In a civilized society, this is viewed as a severe violation of human rights and a blatant infringement on family ethics. It represents a clear 'three-dimensional deprivation' of family, speech, and thought.
4. The 'Cultural Bulldozer' of Forced Assimilation: A Complete Elimination of Diversity
While this law loudly advocates for 'unity', it fundamentally promotes 'forced assimilation'.
It explicitly mandates the widespread promotion and adoption of the 'national common language and script' (Mandarin), requiring schools, preschool education, and public institutions to use it exclusively. This effectively serves to retroactively legitimize the harsh policies that have recently abolished mother tongue education in Xinjiang and Inner Mongolia.
Moreover, it requires internet service providers to implement 'round-the-clock monitoring'. If any speech, images, or videos deemed as 'disrupting unity' appear online, platforms must immediately cut off access, remove the content, and report it to the central authorities.
Taiwan Legislator: With This Evil Law in Effect, Taiwanese Should Be Cautious of Arrest
This draconian law has already drawn international attention.
In April 2026, the European Parliament passed a resolution that strongly condemned the Chinese Communist Party's 'Ethnic Unity and Progress Promotion Law'. The resolution highlights that this law encourages assimilation policies, severely restricts cultural, religious, and linguistic freedoms, and violates the CCP's obligations under international law, urging the CCP government to repeal it.
Recent discussions and assessments by Taiwan's Mainland Affairs Council and national security experts reveal that the "National Unity and Progress Promotion Law of the People's Republic of China" serves as a tool for the Chinese Communist Party (CCP) to enforce "the legalization of ethnic myths" and "assimilation policies." Experts have issued a stark warning that this law could become a powerful instrument for the CCP's "cross-border repression," posing a significant threat to Taiwan and the international community's interactions with China.
Scholars suggest that this law represents a new foundation for the CCP, established by Xi Jinping during a period of economic and political instability, aiming to address legitimacy gaps through a strict legal framework. The forced Sinicization and assimilation will drastically reduce the previously nominal space for "ethnic autonomy," compelling ethnic groups in border regions to adopt a singular perspective on Chinese history and culture, thereby emphasizing a closed and exclusionary "Chinese viewpoint."
Taiwanese legislator Chen Peiyu cautioned that Taiwanese people should be vigilant, as expressing support for Taiwan, criticizing the CCP, or opposing unification outside of China could result in arrest by the CCP. While the CCP has previously imposed penalties for "active Taiwan independence," this new law is even more alarming; any failure to actively support the CCP's unification of Taiwan is deemed illegal in the eyes of the CCP. This implies that advocating for the existence of the Republic of China in Taiwan, the United States, or Europe, or supporting human rights issues related to Tibet and Xinjiang, could lead to legal repercussions from the CCP. Furthermore, the CCP's cross-border arrests are already in progress. Investigations by international human rights organizations and the FBI indicate that the CCP's public security has set up over 102 overseas secret police stations across 53 countries, tasked with intimidating dissenters and even coercing their return to China. She also called on all political parties in Taiwan, regardless of their affiliations, to unite in condemning this severe infringement on the sovereignty of the Republic of China by such a malicious law.
